Terms for Commissioned Work

Framework conditions for commissioned creative services.

1. Scope

These terms apply to commissioned work for both consumers (B2C) and businesses (B2B) in illustration, graphic design, and 3D visualization.

The provider is Cooper Abdi (minor), represented by the legal guardians Azmir Abdi.

2. Scope of Services

Services cover digital creative work, especially illustrations, graphic design, and 3D visualizations.

Deliverables are usually provided as digital files for online or print use.

The production or delivery of hazardous physical products is excluded.

3. Prices and Payment

The commission value is generally up to EUR 250 per project, unless otherwise agreed.

Payment is generally made by invoice. Depending on the scope, a deposit or advance payment may be agreed.

If the small-business regulation under § 19 UStG applies, no VAT is shown.

4. Customer Cooperation

Customers provide a sufficient briefing, relevant references, and timely feedback within agreed deadlines.

5. Corrections and Revisions

The number of revision rounds is agreed in advance (e.g. up to two revision rounds).

Additional services or later change requests are billed separately.

6. Usage Rights

After full payment, a non-exclusive right of use is generally granted within the agreed scope.

Exclusive or extended commercial rights require a separate agreement.

Copyright remains with the provider; attribution is appreciated where practical.

7. Delivery

Delivery is digital (e.g. via email or download link). Delivery timelines are agreed individually.

Upon request, originals can additionally be sent by post. Shipping is arranged in advance as an insured standard parcel service; shipping costs are listed separately in the invoice.

These are exclusively decorative originals without injury or safety risk.

8. Withdrawal (B2C)

For individually created digital content, the right of withdrawal may expire if the customer expressly agrees that performance begins before the withdrawal period ends and confirms awareness of this consequence. In this case, explicit consent is obtained before performance begins. Consent and confirmation are provided in text form (e.g. by email).

9. Liability

Liability is governed by statutory law. Liability applies in particular in cases of intent and gross negligence.

For outcomes or deviations caused by third-party services (e.g. print shops or online platforms), we assume no liability.

Legal checks regarding trademarks, rights, or other materials provided by customers are not part of the service.

For potential liability cases, coverage exists under the private liability insurance of the legal guardians, insofar as the self-employed activity is included.

10. Portfolio and References

We reserve the right to present completed work in anonymized form as portfolio or reference examples. If this is not desired, please provide a clear notice when placing the commission.

11. Final Provisions

German law applies. Mandatory consumer protection provisions remain unaffected.
